A momentous week for the world's most popular bald eagles, and for hundreds of thousands of people who have gotten to know the raptors intimately during the past 10 weeks, was capped Saturday when one of three eagle chicks embarked on its maiden flight.

All three eaglets, made famous thanks to a web-cam that spies on their nest in Decorah, Iowa, on Thursday and Friday had flapped to and from a nearby branch. "Branching" typically precedes maiden flights, and early Saturday one of the young raptors flew a considerable distance from the nest tree, and back again.

Bob Anderson, director of the Raptor Resource Project, said he arrived at the nest tree at dawn local time and could locate only two eaglets. A bit later he witnessed the missing eaglet flying about 200 feet toward the nest tree. It perched on a branch above the 80-foot-high nest, beyond range of the web-cam. It remains unclear how far the eaglet flew but Anderson said it "looked as though it had been flying all of its life."

Ordinarily, this would not be a big deal. Bald eagle chicks are hatched each spring throughout their range and ultimately fly off to live on their own terms. But this is no ordinary situation. Web-cam viewership for the Decorah Eagles has surpassed 153 million. Since the eggs hatched in early April, typical daytime viewership, at a given moment, is between 20,000-30,000. (See the live feed below; it does not show the eaglet's maiden flight.)

Many are repeat visitors, or "Eagleholics." They watch from home, work, and even during late-night hours, thanks to infrared lighting. The more passionate among these admirers have, in essence, adopted the eagle family, and now must say their goodbyes the feathered youngsters, who have grown so remarkably fast.

One Eagleholic, on a Facebook page devoted to the raptors, claimed to already be experiencing "empty-nest syndrome." Another on Saturday posted, "They are almost moving too fast for me."

Said Anderson, whose research group maintains the web-cam: "It has turned into what is probably the world's most logged-on wildlife education tool on earth. Hundreds of thousands of people have been able to see the wonder of nature, the cruelty of nature and the awe of nature. It has been an incredibly popular wildlife education tool. I think it's unparalleled."

Reasons for the immense popularity of this particular raptor web-cam, when so many others exist, stems perhaps from its high quality, the use of non-intrusive night lighting, sound, and a camera that can be panned from a remote location.

The parents, which in recent years have successfully reared other offspring from the same nest, have done an amazing job with this trio. The family has endured snow storms, ferocious winds and sibling squabbles.

While it's time to fledge, however, it does not mean an end to this story. The eagle chicks, while they may or may not return to the nest after maiden flights, will remain in the vicinity for at least six weeks, crying for handouts from their regal, white-crowned parents. Unless they do return to the nest or nearby branches, however, they will not be visible on the web-cam.

For research purposes, Anderson's team will capture one of the eaglets post-fledge eaglets and attach a solar-powered transmitter in an attempt to learn where it will spend the early part of its life.

"Every day we'll be able to tell the world that this bird is in Missouri, Mississippi or Des Moines," Anderson said. "We will have a website that will follow this bird for years to come. The most common question I get is, 'What happens to the babies,' so we're going to try to answer that question."

As for the parents, they'll stay put. In late October, barring incident, they'll begin to rebuild their nest. In December they'll be in full courtship and in February more eggs will be laid.

Will the world be able to keep tabs on the growth of that eagle family, too? Anderson, though he and his team have been besieged by emails and phone inquiries every day for the past 10 weeks, paused before giving an answer.

"I guess we have no choice," he said. "I don't think the world would accept us for not doing this again next year."

He was also a grandfather of three. Donnie was a mama’s boy. He was a big Raiders fan. He loved his low rider cars and listening to his favorite music. He loved being around his family and friends. Donnie was a big joker and definitely the life of the party. Donnie leaves behind a lot of family and friends that will greatly miss him.

I have several questions that would help to prepare for the PS and life afterwards. You mentioned that Earth will lean to the left soon, due to the force of Planet X. In the hour of the PS will the Earth rotate vigorously to the left? If so, and most important, will the strong winds caused by the sudden rotation come from the West or North West? Or from which direction? After the PS how long before the Earth will start rotating again? Can you tell if it will rotate clockwise or anticlockwise as now? Will the existing prevailing winds change?

The lean to the left does not involve windstorms, other than those that might be engendered due to temperature changes. It is an attempt of Earth's N Pole to evade the magnetic press coming from the N Pole of Planet X. Hurricane force winds from the movement of the Earth are only anticipated to occur during the hour of the pole shift itself, when the crust moves 90 degrees within an hour. The direction of these worldwise hurricane force winds can be gauged. For instance, in the N American hemisphere, the winds will come from the NNW because the Bulge of Brazil will be pushed up toward the current location of the N Pole.

The pole shift with 3600 orbital period will be caused by Planet X when it casts the magnetic balance between the Earth and the Sun. Do pole shifts always happen in a same magnetic trimester? So, will the coming pole shift take place in a same magnetic trimester as it was before?

We have stated that the coming pole shift will occur toward the end of a magnetic trimester, which is either at the end of a December, an April, or an August. We decline to state which trimester will be involved, nor in what year.

Humankind has created a major problem: space debris, now threatening long-term space travel. So much space junk has accumulated that the international community must take urgent action to prevent major accidents at high altitude and on Earth.

At least they admitted they made a mistake, though it would be helpful for their credibility when we're out telling people to read zetatalk if they would say upfront "we expect X" instead of "Y will happen on such and such a date".

We have been asked to describe what 2009 will bring, and have declined. You can read into this what you will. We did this for 2008, and make the statement that the pole shift would not occur before Obama took the presidency. No further such revealing statements will be made.
The most noticeable effect of Planet X as seen from Earth seems to be the erratic orbit of Earth's moon. Will the moon encounter more stress during passage than Earth because of its smaller mass? Will the moon survive as Earths satellite? It seems many " moon children " are experiencing above average illnesses and accidents. Is this in part due to the erratic moon?

We have stated that the Moon will hug the Earth during the pole shift, and not be ripped away. We have also stated that the Moon's orbit has become more erratic, more tilted, as Planet X has drawn closer. Chemtrails, as we have stated, are at present to fog up the skies so the presence of Planet X is not discernable. This is an operation run by private individuals, wealthy individuals, not the government. Therefore, it does not have operational code names as you suggest.

Let me say this .... that this is the lowest of lows I've gone in my life . thing's have gotten pretty bad and very rough the last few years,
But some how Thing's have worked out for the best.

Let me see what do I say , it all started last year in Sept finally getting squared away with the DMV making sure Lic and Reg were up to date and Insurance was paid up.

I have underestimated and overlooked patterns that I play out. At moments that mistakes and a chain of events starts it is because my starting point was not clear and than it will play out until another moment and also when I do not look at how this starts, I will do it again.

These moments of where I remember a particular event or action I can see one moment that I remember because it happened before, I recognize it for that reason and I can trace back the timeline to find the trigger and the belief system that casts the shadow as the events I experience.

Within this, many of the things that I end up in that I don’t understand I actually do understand when stepping back and looking at the timeline of my actions and how I got here.

And through the process of tracing back myself I step back from the system I have become and look at it and through looking at it in its totality I see my participation and also myself as the solution.

The why I feel a certain way or experience what I experience is clear and the process becomes a process of how I am going to direct myself in such a way that I am not repeating the same pattern once more.

I remember how the soul system was exactly designed like this: facing the same point life after life again.

No more, I do not accept myself to participate in my mind and judge my mind and I do not allow myself to avoid myself and suppress myself, I do not allow myself to linger in the same time-loop and I do not allow myself to force myself or create opposition and fight against my mind.

For the practical solution I have to ground myself in every moment of every breath. Keep it real, keep it physical Here through breath.

Within this I am prepared for energy patterns that run on energy and for energy systems, participation is required through the mind and through breath I stop the mind as I remain here in and as the physical as breath.

DMV comes to aid of older drivers

Turning left near her home in Monterey just before Christmas 2009, 93-year-old Trudy Star didn't see the oncoming Toyota until it was too late. It crashed into her white Ford Fusion, and there was no question Star was at fault. Fortunately, nobody was hurt.

But when a responding police officer described the feisty, German-born woman, who has a heavy accent, as "incoherent," it raised a big red flag at the Department of Motor Vehicles. Within days, this World War II survivor with a spotless driving record learned that her license had been revoked.

"I was so mad, so frustrated, embarrassed," said Star, now 94, "because no one would listen. I was old, and they assumed I shouldn't be driving."

But a little-known DMV program helped Star get her license back. The Senior Ombudsman Program has given thousands of older motorists a second chance to keep their keys, convinced others to reduce or stop their driving, and given relatives worried about the driving skills of aging parents someone to turn to for advice.

The staff is small, just five people scattered across the state. The ombudsmen are contacted by up to 6,000 people a year and are training police, other DMV workers and doctors on how to deal with older motorists. And they have pushed ahead with changes making it easier to put restrictions on some people's licenses rather than take them away completely.

The program began five years ago, when retired DMV safety instructor

Charley Fenner reflected back on a growing complaint. Older drivers felt ignored and had nowhere to turn if they lost their licenses.

"They would say: 'I've been on this Earth for a lot of years, and nobody is giving me the time of day,' " said Fenner, who came back to the DMV to launch the program for older drivers. —‰'I'm just another body walking through the system, and I resent that. I don't think that's fair.' "

Fenner's answer to those complaints comes as a surprise and a relief to most.

"The first thing I tell them is we're not here to take you off the road," he said. "As a matter of fact, we want to keep you on the road."

The state with the most motorists in the country is approaching what Fenner calls "a driving tsunami." By the end of this decade, 1 in 5 motorists will be older than 65. There will be nearly 10 million people 85 and older by 2030, up 73 percent from today.

Drivers are required to take both written and eye tests when their licenses come up for renewal for the first time after they turn 70. A driving test can be required if those exams raise the concern of the DMV, or if a doctor believes one is necessary.

And drivers can have their licenses restricted to, for example, driving only during the day or only on city streets and not on freeways.

Deciding whether an elderly person should keep driving is a matter of safety vs. quality of life. Once a person can no longer drive, isolation and depression can set in.

"We know for a fact that quality of life, longevity of life, is adversely affected when you lose your mobility," said John Locher, another DMV ombudsman. "You lose your ability to be independent."

This issue tormented one South Bay family, in which an 85-year-old father whose license had just been renewed for five years insisted he should be able to drive, while some relatives wanted him to stop.

One relative contacted Fenner, who laid out their options. One was a restricted license, which would limit when and where he could drive. Eventually, the father was persuaded to restrict his driving to doctor appointments, grocery store trips and morning coffee with friends. If he needs to leave town, a relative takes him.

"For now, I feel comfortable with this solution," said a relative who asked not to be identified to avoid "a family battle I do not want to participate in."

"The ombudsman was helpful and beneficial," she said. "I am sure, like me, many people do not realize there is anything positive or helpful (like this) at the DMV."

Star's first experience with the DMV after her 2009 crash was completely frustrating. Her son, Mike Star, backed her up, saying his mom is not a typical older driver.

"Her skills are good," the younger Star said. "If I felt she shouldn't be driving, I'd say so."

For weeks, he drove from work in Watsonville to Monterey to take her on errands. Worried that he could not continue the almost daily treks to his mom's house, he went on the DMV website and discovered the link to the ombudsman program.

He called the DMV, and on the other end in Oakland was Veronica Conley. Mike Star put her in touch with his mother.

Conley is accustomed to getting calls from seniors in tears from frustration and confusion.

The first thing she did was just listen.

"Listening to all of what they have to say means the world to them," Conley said. "When you're able to let a person know that you will personally look into the issue they are having and do whatever you can to assist them, it's as if you have literally taken a weight from their shoulders."

Conley told Star she would have to take a driving test. She did and passed with ease.

Star is back on the road now and looking forward to her idea of a wonderful day -- a drive along the Pacific Ocean with a San Francisco Giants game on the radio and Tim Lincecum on the mound.

But the crash shook her. She no longer drives on the highway, and she only takes city streets with which she is familiar. And she looks back with appreciation on the people at the DMV who helped her.

"They were so good to me," Star said, "because they were willing to listen to what I had to say. I was not just an old woman to them."

The Super Bowl flyover may have cost $450,000. Was it worth it?

The fans inside Cowboys Stadium for Super Bowl XLV had as good a view of the flyover by four F-18 fighter jets as those watching at home. With the roof closed on Jerry Jones' $1.2 billion stadium, people in attendance were forced to watch the flyover on the massive high-def screens inside.

A Dallas TV reporter estimated that the flyover cost the Navy a total of $450,000. His total includes gas, operational costs and air time for the four F-18s, which traveled from Virginia to Texas for the event. The Navy told CNBC that its official records only tallies the amount spent on gas, which came out to $109,000 for the Super Bowl flights.

Even if we call it somewhere in between, the Navy still spent hundreds of thousands of dollars of taxpayer money for a few seconds of camera time. It's like an old riddle: If four planes fly over a stadium and nobody insides sees, is it worth the cost?

Sally Jenkins of the Washington Post doesn't think so. In a column lambasting the excess of the Super Bowl, she wrote:

For absurdity, how about those four Navy F-18s flying over the stadium -- with its retractable roof closed? Everybody inside could only see the planes on the stadium's video screens. It was strictly a two-second beauty shot.

She's right on one level; for the people inside the stadium, the flyover was a waste. But who says the flyover is about the fans at the game? All the Super Bowl extravagance is geared toward those watching on television, not in attendance. The anthem singers, the halftime shows and the blimp shots are for the viewer at home.

Christina Aguilera isn't making a trip to Dallas to sing a two-minute song in front of 100,000 people. She's doing it for the 100 million watching at home. Game organizers don't get the Black Eyed Peas and the Rolling Stones and Janet Jackson and Prince to stage elaborate halftime shows because fans in section 538 crave them, they do them to entice the casual viewer watching FOX or CBS or NBC to stick around through the first half.

The justification for the flyover is similar. The Navy used the one on Sunday as a recruiting tool. Instead of spending $3 million on a 30-second commercial during the game, it spent $400,000 on a five-second advertisement that everybody watched. Why is it all right for Chrysler to get billions in bailout money and then buy a two-minute advertisement for around $10 million but not for the Navy to use a fraction of its budget to promote itself?

"These missions are included in the annual operating budget of all branches of the military and they are used as training," Mike Maus, deputy public affairs officer for the Naval Air Force's Atlantic division told CNBC. "There was no additional money provided to us, Congress did not cut us a special check to do this flyover. This is considered a training mission whether they were to fly over the Super Bowl or not."

Call it wasteful if you want, but there are far worse ways to spend taxpayer money than promotion of our nation's armed forces.

It's the small appliances that can waste the most electricity.

Digital picture frames are small, so it's hard to think of them as energy hogs. But if each U.S. household had one of these frames running around the clock, it would take five power plants to run them all, says the Electric Power Research Institute (EPRI), an electricity-focused research and development nonprofit.

Large home appliances like refrigerators and dryers are typical examples of energy-hungry devices, but energy hogs don't necessarily need to be large in size. Small devices are also collectively sucking a lot of energy from the power grid, and as these devices become commonplace their energy consumption rises exponentially. "It's the subtlety of the effect of large numbers of very small consuming devices," says Tom Reddoch, the executive director of energy utilization at EPRI.

Other small energy hogs include mobile phone chargers and laptop power adapters that are always plugged in to electric outlets. These chargers continue to draw energy even when the devices they charge have been disconnected. And "always-on" appliances like printers or speakers are called "energy vampires" because they also suck up power even when they're turned off or in an idle state.

Worse yet, the number of always-on devices is on the rise. Reddoch estimates that the typical U.S. home 30 years ago had about three always-on devices; today that number has climbed to more than 30.

Slaying energy vampires, however, is worthwhile in the long run. While a refrigerator typically accounts for about 8% of the typical household's total annual energy consumption, Reddoch says, vampire devices account for about 4%.

What's the best way to rein in energy hogs and vampires? The simplest answer is to turn off and unplug devices when they're not in use. If unplugging isn't practical or convenient, use a smart power strip to help stop the flow of electricity to an idle current. For instance, some smart strips allow you to set up a lead device like a computer so that when it is turned off, other supporting devices, like printers and speakers, are also turned off.

We don't often bother to change a device's default settings, but we can save energy here too. For example, you can manually lower the default brightness and intensity settings on a TV.

Knowing how much energy we waste keeping devices on all the time should also motivate us to change our habits. Kyle Tanger, chief executive of green consultancy ClearCarbon, recommends using an electricity monitor like the Kill A Watt, a product that measures the energy efficiency of household appliances, to give you a better sense of their usage cost.

We can also buy energy-efficient products, and this year happens to be a great time to do that. Consumers are eligible for a rebate from the government when they buy an Energy Star appliance. Check out the U.S. Department of Energy website for more information the rebate program.

"There isn't a secret to what's hogging the energy," says Tanger. "If people pay attention to the little lights or fans in equipment, there is a lot in energy-efficiency gain that isn't just low-hanging fruit -- it's on the ground."

Plasma TVs

Plasma TVs are hot items -- literally. While they are popular, they also consume a lot energy, giving off lots of heat in the process. A typical 27-inch CRT TV uses about 110 to 120 watts and a 42-inch LCD TV uses around 200 watts. Plasmas easily gobble the most: a 42-inch plasma TV uses up to 325 watts.

Digital Picture Frames

Once a high-end item, digital frames are quickly becoming more affordable, with prices as low as $20 to $30. If every home in the U.S. had one of these frames displaying around the clock, though, it would take five power plants alone to power them all, the Electric Power Research Institute estimates.

Videogame Consoles

The high-level graphics processing that creates the visually stunning games on these devices also requires a lot of energy. And a lack of energy-efficiency standards for consoles, like the Xbox 360 and PlayStation 3, doesn't help. The Natural Resources Defense Council estimates that consoles in the U.S. collectively consume around 16 billion kilowatt-hours per year, roughly the same energy usage as the city of San Diego.

Set-Top Boxes

Set-top boxes like cable and converter boxes seem like relatively innocent appliances: They typically only draw about 30 watts of energy. But because these boxes are always on, one box over the course of a year can use up to 265 kilowatt-hours, equivalent to the annual energy consumption of a 28-inch CRT television.

Battery Chargers

Individually chargers for mobile devices like cellphones and PDAs are small energy consumers, only using 7 to 10 watts. But if they are left plugged in to electric outlets even when the charged device is not connected, they continue to draw power. Today most U.S. homes use more than one charger. Add them all up across the country, and they could consume the energy output of several power plants.

Coroner: Boy found in canal drowned

Mom, grandma plan funeral; date not set

Autopsy results of a young boy presumed to be Juliani Cardenas reveal he drowned, the Stanislaus County Sheriff's Department said Wednesday.

The body was discovered by a canal worker in Santa Nella on Tuesday morning, two weeks after Juliani was abducted from his home in Patterson by Jose Esteban Rodriguez, his mother's former boyfriend.

DNA results aren't expected until later this month, but the body matches 4-year-old Juliani's description and was clothed in the kind of black "Spider-Man" shoes and pajamas he was wearing Jan. 18, the day of the abduction.

The canal worker who found the body during a routine check of the Delta-Mendota Canal 31 miles south of where Rodriguez's car entered the water was "shaken" by the experience, according to Bureau of Reclamation spokesman Pete Lucero.

Lucero said the worker was assigned to secure the body while at the same time calling for help.

"(The worker) is shaken up, along with all those who had anything to do with the recovery effort," Lucero said Wednesday. "He has obviously suffered from this."

During the recovery and investigation Tuesday morning, McCabe Road near Santa Nella in Merced County was closed for several hours, blocking the only access to San Joaquin Valley National Cemetery. Seven funerals were postponed because of the closure, said cemetery director Ralph Bennett.

The Cardenas family spent much of Wednesday planning for Juliani's funeral, according to family friend and Patterson City Councilwoman Annette Smith.

A date for the funeral has not been set because the family is coordinating with the Stanislaus County coroner's office.

"They are strong women and they are going through with the processes that they need for the services," Smith said of Juliani's mother, Tabitha, and grandmother Amparo. "They are just trying to get through the day."

Punxsutawney Phil predicts an early spring

PUNXSUTAWNEY, Pa. – The country's most famous groundhog predicted an early spring Wednesday but wasn't willing to go out on a limb to forecast whether his state's Pittsburgh Steelers will win the Super Bowl.

Punxsutawney Phil emerged just after dawn on Groundhog Day to make his 125th annual weather forecast in front of a smaller-than-usual crowd in rural Pennsylvania who braved muddy, icy conditions to hear his handlers reveal that he had not seen his shadow.

Including Wednesday's forecast, Phil has seen his shadow 98 times and hasn't seen it just 16 times since 1887, according to the Punxsutawney Groundhog Club's Inner Circle, which runs the event. There are no records for the remaining years, though the group has never failed to issue a forecast.

Two years ago, Phil's forecast also acknowledged the Steelers' Super Bowl XLIII win the night before. This year, Sunday's game was mentioned in the forecast but no winner was predicted between the Steelers and the Green Bay Packers, who meet in Dallas for Super Bowl XLV.

"The Steelers are going to the Super Bowl," Mike Johnson, vice president of the Inner Circle, said just before the forecast was read, drawing cheers from the clearly partisan crowd gathered on Gobbler's Knob, a tiny hill in this borough of about 6,100 residents some 65 miles northeast of Pittsburgh.

The Groundhog Day celebration is rooted in a German superstition that says if a hibernating animal casts a shadow on Feb. 2, the Christian holiday of Candlemas, winter will last another six weeks. If no shadow was seen, legend said spring would come early.

In reality, Pennsylvania's prophetic rodent doesn't see much of anything. The result is actually decided in advance by 14 members of the Inner Circle, who don tuxedos and top hats for the event.

The celebration usually draws 10,000 to 15,000 spectators when it falls on a weekday, Groundhog club spokesman Luke Webber said. The area was under a winter weather warning and while heavier snows and sleet never materialized, rain falling in about 35-degree temperatures made for a below-average crowd, said Webber, who offered no specific estimate.

A child's body was found in the Delta-Mendota Canal near Santa Nella today, the Stanislaus County Sheriff's Department reported. The child's identity and sex were not immediately known.

The body was found this morning about 30 miles downstream from where investigators believe a 4-year-old Patterson boy and his abductor entered the canal in the kidnapper's car Jan. 18.

The search for little Juliani Cardenas has focused on the canal, from which the Toyota belonging to suspect Jose Esteban Rodriguez was pulled Friday. No bodies were in the car.

Sheriff's spokesman Royjindar Singh said there would be a news conference in Patterson between 11 a.m. and noon today.

Singh did not say under what circumstances the body was found. Detectives recovered the body at mid-morning.

PATTERSON, Stanislaus County (CBS 5 / AP) ― Authorities pulled a kidnapping suspect’s car from the bottom of a frigid Central California canal Friday, but the bodies of the suspect and the missing 4-year-old boy were not inside.

The badly damaged Toyota Corolla recovered from the Delta-Mendota canal along with two other vehicles just before 6 p.m. was empty, Stanislaus County Sheriff Adam Christianson said.

The car belongs to 27-year-old Jose Rodriguez, who is suspected of kidnapping Juliani Cardenas, his ex-girlfriend’s son, from the arms of the boy’s grandmother in Patterson on Jan. 18. Juliani’s mother, Tabitha Cardenas, reportedly ended her relationship with Rodriguez several months ago, and he is the father of her unborn child.

Christianson said authorities will continue to search the canal for the bodies in the event they floated downstream. He said there is no evidence that Rodriguez fled the scene after dumping the car.

“He is not sophisticated enough, doesn’t have the infrastructure, doesn’t have the financing and doesn’t have the support to pull off that type of abduction,” the sheriff said.

Two of the car’s windows were down when it was pulled from the canal, Christianson said.

Divers have been combing the canal since last week after receiving a tip that a car matching the one in which Rodriguez allegedly fled was seen heading into the water. They recovered 13 cars before pulling out the final three on Friday.

Rodriguez’s car was found using sonar Friday morning in a tunnel about 50 feet below the surface. An underwater camera showed its license plate and confirmed the vehicle was the suspect’s 2003 silver Corolla, Christianson said.

A single diver entered the murky, 42-degree water shortly after 4 p.m. to attach a line to the car so a tow truck could drag it from the canal. A backup diver was in the water to assist.

During a briefing for reporters Friday afternoon, Christianson said he feared the worst.

“We’re certainly saddened by the fact that we found the car even though we knew we would,” he said. “As these days have progressed, we knew that the likelihood of bringing little Juliani home alive was diminishing exponentially.”

He struck a more optimistic note Friday evening, telling reporters: “We’re going to continue to search the canal downstream. We’re going to continue to look and hold out hope.”

Divers Say License Plates Match Vehicle Found in Canal with Car Named in Amber Alert for Juliani Cardenas

PATTERSON (KRON) -- A diver for the Merced County Sheriff's department says the license plates on Toyota Corolla found Friday morning in the Mendota-Delta canal match those on the car named in the Amber Alert for four-year old Juliani Cardenas.

Authorities say the car was found wedged in an area near a siphon that sucks water through the canal. Investigators say it could be mid-afternoon before they can retrieve the vehicle in what they call a "very dangerous dive."

Today's discovery marks an important milestone in the search for Juliani whose grandmother says Jose Rodriguez snatched from her arms on January 18th. The search has focused on the canal after a farm worker reported seeing a vehicle matching the description with a man and a child inside going into the waters soon after the kidnapping.

Authorities say there's been no activity on Rodriguez's cell phone or debit cards since the kidnapping. Rodriguez is Juliani's mother's boyfriend and the father of the child she is now carrying.

Jack LaLanne, Founder of Modern Fitness Movement, Dies at 96

Jack LaLanne, whose obsession with grueling workouts and good nutrition, complemented by a salesman’s gift, brought him recognition as the founder of the modern physical fitness movement, died Sunday afternoon at his home in Morro Bay, Calif. He was 96.

The cause was respiratory failure resulting from pneumonia, said his son Dan Doyle.

A self-described emotional and physical wreck while growing up in the San Francisco area, Mr. LaLanne began turning his life around, as he often told it, after hearing a talk on proper diet when he was 15.

He started working out with weights when they were an oddity, and in 1936 he opened the prototype for the fitness spas to come — a gym, juice bar and health food store — in an old office building in Oakland.

“People thought I was a charlatan and a nut,” he remembered. “The doctors were against me — they said that working out with weights would give people heart attacks and they would lose their sex drive.” But Mr. LaLanne persevered, and he found a national pulpit in the age of television.

“The Jack LaLanne Show” made its debut in 1951 as a local program in the San Francisco area, then went nationwide on daytime television in 1959. His short-sleeved jumpsuit showing off his impressive biceps, his props often limited to a broomstick, a chair and a rubber cord, Mr. LaLanne pranced through his exercise routines, most notably his fingertip push-ups.

He built an audience by first drawing in children who saw his white German shepherd, Happy, perform tricks.

“My show was so personal, I made it feel like you and I were the only ones there,” he told Knight-Ridder Newspapers in 1995. “And I’d say: ‘Boys and girls, come here. Uncle Jack wants to tell you something. You go get Mother or Daddy, Grandmother, Grandfather, whoever is in the house. You go get them, and you make sure they exercise with me.’ ”

His show continued into the mid-1980s.

“He was perfect for the intimacy of television,” Robert Thompson, a professor of television and popular culture at Syracuse University, told The San Jose Mercury News in 2004. “This guy had some of the same stuff that Oprah has and Johnny Carson had — the ability to insinuate themselves in the domestic space of people’s lives.”

Long before Richard Simmons and Jane Fonda and the Atkins diet, Mr. LaLanne was a national celebrity, preaching regular exercise and proper diet. Expanding on his television popularity, he opened dozens of fitness studios under his name, later licensing them to Bally. He invented the forerunners of modern exercise machines like leg-extension and pulley devices. He marketed a Power Juicer to blend raw vegetables and fruits and a Glamour Stretcher cord, and he sold exercise videos and fitness books. He invited women to join his health clubs and told the elderly and the disabled that they could exercise despite their limitations.

At 60 he swam from Alcatraz Island to Fisherman’s Wharf handcuffed, shackled and towing a 1,000-pound boat. At 70, handcuffed and shackled again, he towed 70 boats, carrying a total of 70 people, a mile and a half through Long Beach Harbor.

He ate two meals a day and shunned snacks.

Breakfast, following his morning workout, usually included several hard-boiled egg whites, a cup of broth, oatmeal with soy milk and seasonal fruit. For dinner he took his wife, Elaine, to restaurants that knew what he wanted: a salad with raw vegetables and egg whites along with fish — often salmon — and a mixture of red and white wine. He sometimes allowed himself a roast turkey sandwich, but never a cup of coffee.

Mr. LaLanne said he performed his exercises until he experienced “muscle fatigue,” lifting weights until it was impossible for him to continue. It produced results and, as he put it, “the ego in me” made the effort worthwhile.

The son of French immigrants, Jack LaLanne was born in San Francisco on Sept. 26, 1914, and spent his early years on his parents’ sheep farm in Bakersfield, Calif. By the time he was 15, the family having moved to the Bay Area, he was pimply and nearsighted, craved junk food and had dropped out of high school. That is when his mother took him to a women’s club for a talk by Paul C. Bragg, a well-known speaker on health and nutrition.

That talk, Mr. LaLanne often said, turned his life around. He began experimenting with weights at the Berkeley Y.M.C.A., tossed aside cakes and cookies and studied Gray’s Anatomy to learn about the body’s muscles. He graduated from a chiropractic school, but instead of practicing that profession he became a pitchman for good health.

He opened his first health studio when he was 21, and a decade and a half later he turned to television. He was first sponsored by the creator of a longevity pill, a 90-year-old man, but it sold poorly and he obtained Yami Yogurt as his new sponsor. “It tasted terrible, so I mixed it with prune juice and fruits,” he told The New York Times in 2004. “Nobody thought about it until then. We made the guy a millionaire.”

Mr. LaLanne, 5-foot-6 and 150 pounds or so with a 30-inch waist, maintained that he disliked working out. He said he kept at it strictly to feel fit and stay healthy. He built two gyms and a pool at his home in Morro Bay, and began each day, into his 90s, with two hours of workouts: weight lifting followed by a swim against an artificial current or in place, tied to a belt.

“The Jack LaLanne Show” may have run its course in the mid-1980s, but it had a second life in reruns on ESPN Classic. “We have over 3,000 shows,” Mr. LaLanne said in 2004. “I own everything.”

In September 2007, “Jack LaLanne Live!” made its debut on the online VoiceAmerica Health and Wellness Radio Network. He appeared on it with his wife and his nephew Chris LaLanne, a personal trainer.

In addition to Dan Doyle, he is survived by his wife, Elaine; their son, Jon; and a daughter, Yvonne.

Mr. LaLanne promoted himself and his calling into his final years, often accompanied at events by his wife, a physical fitness convert but hardly a fanatic. He brimmed with optimism and restated a host of aphorisms for an active and fit life.

“I can’t die,” he most famously liked to say. “It would ruin my image.”

Law-breaking photographer saves the life of Maverick's surfer

Russell Ord wasn't supposed to be in near the lineup at Maverick's on his Wave Runner Saturday. Technically, he was breaking a recently passed ban on personal watercraft in the Monterey Bay Marine Sanctuary imposed by NOAA.

Luckily, that didn't stop him from taking photographs of surfers braving a clean late January swell this weekend.

While his presence there may have miffed some, it's clear now that his quick action saved the life of surfer Jacob Trette when disaster struck in the morning. Ord's life-saving action is exactly why many surfers opposed the ban in the first place, citing the lack of life-saving apparatus allowed near the break on big days as a danger.

The incident occurred at approximately 9:45 am Saturday morning, when a huge set of waves caught a number of surfers by surprise. Many of them had been lured closer to shore where cleaner waves were breaking more consistently on the higher tide. Then suddenly a huge 25-foot cleanup set approached, heaving way outside of where the pack was sitting. Surfers scrambled and scratched for the horizon to avoid being pummeled. Trette was one of the unlucky ones.

The 30-year-old surfer was sucked over the falls by the first wave after failing to make it over. (He's visible in in the middle of the shot above, paddling the green board.) When he finally resurfaced Trette was staring straight at another 20-foot wave crashing down on him. He endured two two-wave hold downs before being washed through the rocks inside.

When the set approached Ord was sitting safely in the channel on his ski, but sprang into action as soon as the 20-foot set cleared. In the commotion, he nabbed Alex Bottello, another victim, and pulled him out of the impact zone. He was zipping Bottello toward shore when the two spotted Trette's lifeless body floating face-up in the frothy whitewater way inside.

Ord jumped in the water and pulled him onto the rescue sled attached to his ski. Bottello then held Trette's body in place on the sled while Ord raced to shore, where an EMT and another surfer skilled in CPR went to work on Trette. They continued until Firefighters arrived and managed to get a pulse.

Trette was later air lifted to Stanford Medical Center, where according to the San Francisco Chronicle, he was put into a medically induced coma after arriving. As of Sunday morning, no official update on his condition has broken, but according to the Half Moon Bay Review, renowned local photographer/lifesaver Frank Quirarte, the man spearheading this year's annual big wave competition, gave an unofficial update on Trette's status early Sunday:

"As of last evening Jacob was moving his arms and legs and his pupils are dilating. They're lowering his body temp so he doesn't use as much oxygen and keeping him heavily sedated. He has an anoxic brain injury do to lack of oxygen to the brain. To early to tell how much damage has been done if any. Sending our prayers to him and his family."

Back in 2007 and 2008, when the ban was being debated, Quirarte was adamantly lobbying for logic, citing the safety issue to surfers. His side lost.

Saturday's incident is likely to bring the wisdom of NOAA's ban back into question. Ever since the 1994 death of big-wave surfing legend Mark Foo at Maverick's photographers based on land and in the water have become a vital part of the rescue team efforts when surfers get in trouble.

Both groups carry radios and stay in communication with each other to identify victims in need of help. "The ban has completely broken that system down," says veteran Maverick's photographer Don Montgomery. "If something happens to Jacob or any of these surfers there's no question it's on NOAA's shoulders. Had the usual crafts been out there, including Frank's [Quirarte], we would have been on Jacob much faster. Russel didn't even see him until late because he was already helping somebody else."

HOUSTON (Reuters) - Representative Gabrielle Giffords has begun what will likely be a months-long recovery at a Houston rehabilitation center two weeks after being shot in the head by an Arizona gunman, medical staff said on Saturday.

The day after Giffords flew in a private plane to Houston's massive Texas Medical Center from Tucson, she is in the early stages of therapy in the intensive care unit of Memorial Hermann hospital.

"She's doing very well," said Gerard Francisco, chief medical officer at the Institute for Rehabilitation and Research at Memorial Hermann, who is overseeing Giffords' months-long rehabilitation journey.

"We initiated therapy yesterday and had therapy today as well," Francisco told reporters on a tour of the rehab center. "She is responding very well."

Giffords, 40, suffered a gunshot wound to the head at close range on January 8 when a gunman opened fire at an event where she was meeting with constituents. Doctors have described her progress so far as akin to a miracle.

Jared Lee Loughner, a 22-year-old college dropout, is charged with the shooting. Six bystanders including a federal judge and a 9-year-old girl were killed in the incident, and 13 others were wounded, Giffords among them.

Giffords remains in the intensive care unit because of a drain in place to remove a buildup of fluid in her skull, which puts her at higher risk for infection.

REHAB UNDER WAY

Even in the intensive care ward, Giffords could undergo some rehab activities, including moving in bed, sitting and standing, and other strengthening exercises, Francisco said.

Giffords will get more intensive rehabilitation at the Institute for Rehabilitation and Research, renowned for its treatment of brain and spinal cord injuries. Once she is out of the intensive care unit, doctors said, she faces at least four to six months of intensive therapy.

Rehabilitation center staff gave journalists a tour of their facilities -- including a large gymnasium-like room full of exercise mats, weight machines and treadmills where brain-injury patients relearn the rudimentary movement skills.

"The biggest challenge is discipline - you have to repeat things so many times," said Lex Frieden, a rehabilitation expert at the hospital.

Giffords will likely have to relearn basic skills like tying her shoes, and "the repetition is boring and requires a lot of discipline," Frieden told reporters.

The rehabilitation center is decked out with specialized equipment, including a weight-assisted treadmill that suspends patients in a harness and allows them to relearn walking skills without bearing their full weight.

Gabrielle Giffords got a dramatic send-off from her hometown Friday as throngs of sign-carrying well-wishers lined the streets to wave at the ambulance taking the wounded congresswoman from the hospital to the airport, where she was flown to Houston just two weeks after she was shot.

The trip by ambulance, jet and helicopter took her to a Houston hospital where she will undergo weeks of rigorous rehabilitation.

"We want to be here to help her and show her a good farewell, and hope that she has a great recovery," said Al Garcia, a Marine veteran who came on his Harley Davidson motorcycle. "It's through all of these prayers that she's leaving in just two weeks."

A gunman shot Giffords and 18 other people Jan. 8 as she met with constituents outside a grocery store in Tucson. Six people died; all other survivors have been released from the hospital. The suspect in the attack, Jared Loughner, 22, of Tucson, is being held in federal custody.

Giffords has been making progress nearly every day at University Medical Center in Tucson. Her husband, Houston-based astronaut Mark Kelly, tweeted Friday: "GG going to next phase of her recover today. Very grateful to the docs and nurses at UMC, Tucson PD, Sheriffs Dept....Back in Tucson ASAP!"

Kelly traveled with Giffords, along with her mother, a doctor and other medical workers. A helicopter took her from the Houston airport to the ICU at Texas Medical Center, where she'll be evaluated before going to the center's rehabilitation hospital, TIRR Memorial Hermann. U.S. Capitol police arrived Thursday afternoon to set up extra security measures at the 119-bed facility.

Despite the steady progress, doctors warn Giffords has a long road to recovery. Doctors are not sure what, if any, disability she will have.

She moves her lips, but it's not clear whether she is mouthing words, nor how much she is able to see.

"Not everyone always gets 100 percent restoration, but we help them to get to a new normal," said Carl Josehart, chief executive of the rehab hospital that will be Giffords' home for the next month or two.

Dr. Gerard Francisco, the hospital's chief medical officer, will coordinate her care.

"It's going to be a very big team that will address different impairments, but they will have to work together," he said.

First, they'll check her vital signs — make sure her blood pressure and heart rate are good. Then specialists ranging from physical and occupational therapists to speech therapists and psychologists will give a slew of tests to see what she can and cannot do.

They'll determine the strength of her legs and her ability to stand and walk; the strength of her arms, and whether she can brush her teeth or comb her hair; whether she can safely swallow on her own; how well she thinks and communicates — not just her ability to speak but also to understand and comprehend.

While she is moving both arms and legs, it's uncertain how much strength she has on her right side; the bullet passed through the left side of her brain, which controls the right side of the body.

Giffords will stay at Memorial Hermann until she no longer needs 24-hour medical care — the average is one to two months. Then she can get up to five hours a day of physical and other rehab therapies on an outpatient basis, Josehart said.

"It's hard to speculate on the trajectory or course that any one patient will have," he said.

Sometimes, areas of the brain that seem damaged can recover, said Mark Sherer, a neuropsychologist at the rehab center.

"Some of the tissue is temporarily dysfunctional, so the patient appears very impaired very early on after the injury," but may not be permanently damaged, he said.

Kelly said Giffords would be proud of the way Tucson has responded. Memorials continued to grow Friday outside the hospital, in front of her office and at the scene of the shooting.

"I know one of the first things Gabby is going to want to do as soon as she's able to is start writing thank you notes," he said.

Dave Sanderson stood along the ambulance route as Giffords left, along with his dog who had an American flag attached to its collar. Sanderson said he's been coming to the memorial outside the hospital every day since the shooting happened.

"I just wanted to wish her well and the best of luck," he said.

TUCSON - The astronaut comes to the hospital before sunrise, and he leaves quite late. And when he walks past the makeshift memorial on the lawn left for his wife and the other shooting victims, he feels hope, and sadness, and something that's hard to explain.

It can be almost "spiritual," said Mark Kelly, U.S. Rep. Gabrielle Giffords' husband, "when you show up in the morning and there's this young woman with a drum -- just boom, boom -- and nobody else is out there, and she's been ... keeping this personal vigil."

Kelly is 10 days into his own vigil at Giffords' side. By now, he says, he's sure that she knows he's there because of the way she reaches up to touch his face, like always. And he's also sure of this:

"She will make a full recovery. ... She's going to come back stronger and more committed than ever," he said. There's no question, he said, that Giffords will return to her congressional post.

"I can almost guarantee you what her first event will be," he said. "I'd be shocked if the first thing she does is not 'Congress on Your Corner' at that Safeway.

"That's the kind of person she is," said Kelly, 46, who married Giffords at an organic farm in Amado in November 2007.

She was shot in the forehead by a gunman who killed six and wounded 12 others at Giffords' meet and greet outside the grocery store Jan 8. Inside a locked box belonging to shooting suspect Jared Loughner, 22, police found scrawled notes that included the words "die, bitch" and "Giffords."

Giffords wouldn't allow threats to keep her from meeting her constituents, Kelly said, though she worried for her safety.

"She would say, 'I'm somewhat concerned that at some point, someone's going to shoot me,' " Kelly told Arizona reporters in a news conference Tuesday afternoon at University Medical Center, where Giffords is recovering. "We talked about it at least a dozen times. We talked about it two weeks ago."

In March, a vandal shattered a window at Giffords' Tucson office shortly after she cast a vote in favor of the health-care bill.

"When everything got really heated," Kelly said, he suggested to her that she reduce her public appearances, even getting angry himself when constituents would yell at Giffords during events. She insisted it came with the job.

"She really feels it's important to let people say to her, face to face, what their concerns are and what they think about the job she's doing," Kelly said.

When he heard what happened, Kelly was at home with his daughters near Houston, where he has been preparing to command the Endeavour space-shuttle mission in April. They were discussing the girls' text-messaging habits, he said, when he received a call from Pia Carusone, Giffords' chief of staff.

She "said Gabby had been shot and she didn't have any information, and I hung up ... and then I just couldn't believe it, you know, I just couldn't believe it," he said. Kelly looked at his call history to make sure he hadn't imagined it, he said, and saw Carusone's name, "and then I called her back and asked her again, 'What did you say?' "

He quickly called Giffords' parents and his own parents, and found a friend to fly him to Tucson on a private plane. He arrived around 2:30 p.m., about four hours after the shooting.

In the first three days, he slept a total of about eight hours, he says, catching small naps in spare beds. For the first five days, he never left the hospital. He attended all the funerals that he could -- because Gabby would want him to -- and met with President Barack Obama and Michelle Obama. It's all a blur, he says, even Obama's televised memorial.

"I know the first lady at one point squeezed my hand really hard," he said.

Kelly is resting at least six hours at night now, he says, since he realized he needs to be rested and sharp enough to make important medical decisions.

"In a very odd way, this feels a lot like a space-shuttle mission -- a lot of decisions, long days, a lot of chaos, all at once, things that aren't working right, things ... you have to fix," he said. "In a way, it's helpful that I can just go into that mode of being focused."

Kelly says UMC doctors "have done everything perfectly," but he also asked other surgeons to come consider his wife's case, including the former head of neurosurgery at Walter Reed Army Medical Center and a Johns Hopkins neurologist.

Kelly says Giffords knows she has suffered a serious injury, but that he hasn't told her exactly what happened, or informed her about the other victims and deaths. Her neurosurgeon says there is a chance she may remember the shooting, Kelly said, but probably not.

Meanwhile, Kelly continues his vigil. Giffords is now breathing on her own, and on Saturday had surgery to repair her eye socket, her doctors said. On Tuesday, Kelly said she was awake more, and he continues to find comfort in small things: cards from fourth-graders that include well wishes and their lunch money ($2.52 from Isaac Saldana of Craycroft Elementary School), and the way his wife looks at him.

"She's looking right in my eyes. She knows it's me, I have no doubt," he said. Sometimes, when he is holding her hand, she slips off his wedding ring, "and starts playing with it," he said.

"She'll put it on her finger. She'll flip it around to the other one, then she'll put it back on."

And that's his Gabby, right there, he said, twisting his dark gray band as he spoke,

because that's exactly what "she used to do all the time."

Connie Green, founder and head huntress of Wine Forest Wild Mushrooms, with baskets of chanterelles, blacks, matsutake, blewitt, hedgehog, and yellow feet mushrooms gathered the forests of Northern California.

For those who rarely venture into the woods, the North Coast's rolling hills and forests appear dormant in the winter, a blank slate waiting for spring to bring them back to life.

But for professional foragers with keen eyes and palates — such as Connie Green, head huntress of Wine Forest Wild Mushrooms in Napa — the wet winters of Wine Country usher in an endless season of bounty, producing wave after wave of mushrooms.

“Three weeks after the rains start, our mushrooms come to life, and they will continue well into April,” Green said in a phone interview from her home high in the Mayacmas between Sonoma and Napa counties. “It begins with porcini, and then chanterelles, and then the black trumpets and the hedgehogs and yellow-feet.”

For Green, who recently published “The Wild Table” cookbook with Napa Valley chef Sarah Scott, this year's steady stream of storms has been a gift beyond her wildest dreams.

“Last year and this year are particularly good mushroom years,” she said. “We've had a great deal of water.”

At this time of the year, Green is harvesting mostly black trumpets and hedgehogs, yellow-feet and chanterelle mushrooms in Sonoma, Napa and Mendocino counties. She sells her wild fungi to almost every high-end chef in Wine Country, from Cyrus' Douglas Keane to the French Laundry's Thomas Keller.

Now that wild mushrooms such as chanterelles are sold in Whole Foods and Costco, it appears that the much-maligned mushroom has finally entered the hearts, minds and mouths of mainstream America.

Scientists warn California could be struck by winter ‘superstorm’

A group of more than 100 scientists and experts say in a new report that California faces the risk of a massive "superstorm" that could flood a quarter of the state's homes and cause $300 billion to $400 billion in damage. Researchers point out that the potential scale of destruction in this storm scenario is four or five times the amount of damage that could be wrought by a major earthquake.

It sounds like the plot of an apocalyptic action movie, but scientists with the U.S. Geological Survey warned federal and state emergency officials that California's geological history shows such "superstorms" have happened in the past, and should be added to the long list of natural disasters to worry about in the Golden State.

The threat of a cataclysmic California storm has been dormant for the past 150 years. Geological Survey director Marcia K. McNutt told the New York Times that a 300-mile stretch of the Central Valley was inundated from 1861-62. The floods were so bad that the state capital had to be moved to San Francisco, and Governor Leland Stanford had to take a rowboat to his own inauguration, the report notes. Even larger storms happened in past centuries, over the dates 212, 440, 603, 1029, 1418, and 1605, according to geological evidence.

The risk is gathering momentum now, scientists say, due to rising temperatures in the atmosphere, which has generally made weather patterns more volatile.

The scientists built a model that showed a storm could last for more than 40 days and dump 10 feet of water on the state. The storm would be goaded on by an "atmospheric river" that would move water "at the same rate as 50 Mississippis discharging water into the Gulf of Mexico," according to the AP. Winds could reach 125 miles per hour, and landslides could compound the damage, the report notes.

Such a superstorm is hypothetical but not improbable, climate researchers warn. "We think this event happens once every 100 or 200 years or so, which puts it in the same category as our big San Andreas earthquakes," Geological Survey scientist Lucy Jones said in a press release.

TUCSON, Ariz. -- Mark Kelly, the husband of Rep. Gabrielle Giffords, spoke publicly for the first time Sunday, leaving his wife's hospital bedside to take the stage at a memorial service for Gabriel Zimmerman, an aide who was killed in the shooting rampage that left Giffords grievously wounded.

Kelly told the several hundred mourners gathered in the courtyard at the Tucson Museum of Art that he had just come from the hospital and that his wife was "improving a little bit each day. She's a fighter."

"I know someday she'll get to tell you how she felt about Gabe herself," Kelly said.

His wife loved Zimmerman "like a younger brother," he said, and was inspired by "his idealism, his strength and his warmth."

At almost the exact same time, about a half-hour's drive east, another shooting victim -- Dorwan Stoddard, 76, known as "Dory" to friends -- was eulogized at a church filled with hundreds of mourners.

"There are no monuments to Dory, there are no streets named after him," said the Rev. Mike Nowak, his pastor. "He was just an ordinary man. He did not become a hero that day -- he was a hero every day of his life."

At University Medical Center, officials said Sunday that Giffords' condition was upgraded to serious from critical because she was no longer on a ventilator. Doctors announced Saturday that they placed a tracheotomy tube in Giffords' throat as a precautionary measure.

The accused gunman, Jared Loughner, is in the custody of federal marshals at the medium-security Federal Correctional Institution in Phoenix, which houses almost 1,100 prisoners about 25 miles north of downtown Phoenix. The funerals Sunday marked the fourth and fifth for victims of the tragedy, leaving just one remaining, that of Dorothy Morris, 76, whose husband, George, remains hospitalized after the shooting. The date has not yet been set, said Bill Royle, a family friend, because it depends in part on Morris' recovery from his wounds.

Despite the tears, it seemed on this cool, sunny day that this reeling community had finally begun to slip back into a semblance of its former rhythms as the horde of news media that descended upon the city finally began to pack up and leave.

Grocery carts trundled through the aisles at the Safeway where the shooting occurred, though shoppers continued to pause and reflect in front of a makeshift memorial outside.

(CBS/ AP) The University Medical Center in Tucson announced Sunday that Congresswoman Gabrielle Giffords was upgraded from critical condition to serious condition.

The reason for the upgrade is that Giffords has been taken off a ventilator and is now breathing on her own. Procedures done on Saturday we're "successful and uneventful." Two other patients were upgraded to good condition but UMC did not name them.

Giffords was shot in the head on Jan. 8, 2011, at an event outside a grocery store in Tucson.

Another shooting victim, James Eric Fuller, found himself in the news over the weekend. CBS News has confirmed that Fuller was charged with threatening and intimidation, and disorderly conduct. The 63-year-old Fuller was arrested Saturday and taken for a psychiatric exam.

Trent Humphries, co-founder of the Tucson Tea Party, is worried about the threats he is receiving, including the remark he says Fuller made to him at a televised town hall meeting. Humphries told The Associated Press on Sunday he was surprised when Fuller took a picture of him and said, "you're dead."

Fuller was shot in the knee and back in the Tucson shooting rampage that left six people dead and 14 wounded.
